PDL leaders must give up their hopes of merged local and general elections, and prepare for separate ballots, as the Constitutional Court ruled that the terms of local elects cannot be extended by 6 months.
County council presidents, counselors, mayors and local counselors will thus be elected at the due term, as constitutional magistrates ruled that extending their mandates may only be decided in emergency situations, which is not the case now. Local elections will thus be held in June this year. If PDL still wants to also hold the parliamentary elections together with the local ballot, the only possibility would be to move the general elections earlier, the day of the local ballot. The plan however would imply the resignation of the Cabinet, followed by the Parliament rejecting two successive proposals of a new Executive. Plus, it would shorten by six months the mandates of acting MPs, something even PDL’s own MPs might oppose.
Judges also declared as non-constitutional the text that would have prevented a citizen from running in elections for the Parliament and also for a position with the local administration.
Alegerile locale vor avea loc în luna iunie 2012
Liderii PDL îşi puseseră mari speranţe în stratagema de comasare a alegerilor, dar acum, trebuie să-şi schimbe planurile. Mandatele aleşilor locali nu pot fi prelungite cu şase luni, a stabilit Curtea Constituţională.
Mandatele preşedinţilor de consilii judeţene, concilierilor, primarilor şi consilierilor locali nu pot fi prelungite, au decis magistraţii Curţii Constituţionale. Aceştia au finalizat, , motivarea pe baza căreia a respins legea care prevedea că alegerile locale vor avea loc în aceeaşi zi cu cele parlamentare.
Prelungirea cu şase luni a mandatelor aleşilor locali poate avea loc doar în situaţii de urgenţă, caz ce nu poate fi invocat în actualele circumstanţe, consideră Curtea. Efectul unei asemenea decizii este că alegerile locale ar trebui să aibă loc în luna iunie a acestui an, când expiră mandatele actualilor aleşi. Dacă PDL îşi menţine intenţia de a comasa alegerilor parlamentare cu cele locale, o poate face în luna iunie şi nu în luna noiembrie cum preconiza iniţial. Un asemenea plan ar presupune însă demisia Guvernului, picarea în Parlament a două propuneri de Executiv. Mai mult, ar echivala cu scurtarea mandatelor actualilor parlamentari şi este posibil să fie respinsă chiar din interiorul PDL.
Judecătorii au declarat neconstituţional şi articolul prin care se interzicea aceleiaşi persoane să candideze şi pentru un loc în Parlament, şi pentru unul în administraţia locală.
